Artikel 143c[Entschädigung für die Aufgabe gemeinsamer Aufgaben]
(1) Den Ländern stehen ab dem 1. Januar 2007 bis zum 31. Dezember 2019 für den durch die Abschaffung der Gemeinschaftsaufgaben Ausbau und Neubau von Hochschulen einschließlich Hochschulkliniken und Bildungsplanung sowie für den durch die Abschaffung der Finanzhilfen zur Verbesserung der Verkehrsverhältnisse der Gemeinden und zur sozialen Wohnraumförderung bedingten Wegfall der Finanzierungsanteile des Bundes jährlich Beträge aus dem Haushalt des Bundes zu. Bis zum 31. Dezember 2013 werden diese Beträge aus dem Durchschnitt der Finanzierungsanteile des Bundes im Referenzzeitraum 2000 bis 2008 ermittelt.
(2) Die Beträge nach Absatz 1 werden auf die Länder bis zum 31. Dezember 2013 wie folgt verteilt:
- als jährliche Festbeträge, deren Höhe sich nach dem Durchschnittsanteil eines jeden Landes im Zeitraum 2000 bis 2003 errechnet;
- jeweils zweckgebunden an den Aufgabenbereich der bisherigen Mischfinanzierungen.
(3) Bund und Länder überprüfen bis Ende 2013, in welcher Höhe die den Ländern nach Absatz 1 zugewiesenen Finanzierungsmittel zur Aufgabenerfüllung der Länder noch angemessen und erforderlich sind. Ab dem 1. Januar 2014 entfällt die nach Absatz 2 Nr. 2 vorgesehene Zweckbindung der nach Absatz 1 zugewiesenen Finanzierungsmittel; die investive Zweckbindung des Mittelvolumens bleibt bestehen. Die Vereinbarungen aus dem Solidarpakt II bleiben unberührt.
(4) Das Nähere regelt ein Bundesgesetz, das der Zustimmung des Bundesrates bedarf.
第143c条 [共同任務の廃止に対する補償]
(1) 大学病院や教育計画を含む大学の拡大と新設という共同任務の廃止に、並びに、市町村の交通事情の改善し、社会的住居促進のための財政援助の廃止の結果、連邦の廃止の財政負担分がなくなったことにより、諸ラントは、2007年1月1日から2019年12月31日まで、連邦予算から年間一定額が与えられる。2013年12月31日まで、この金額は2000年から2000年の調査期間における連邦の財政負担分の平均値に基づいて与えられる。2013年12月31日まで、これらの金額は、2000年から2008年の基準期間における連邦の財政負担の平均から決定される。
(2) 第1項に基づく金額は、次のように2013年12月31日まで諸ラントに分配されまる：
- 2000年から2003年までの期間における各ラントの平均負担分に従って計算される年間固定額として、
- 従来の重複財政措置の任務分野におけるその時々の目的に限定して。
(3) 連邦および諸ラントは、2013年末までは、第1項によってラントに配分されるラントの任務遂行のための財政資金が、どの程度さらに適切かつ必要であるかを審査する。2014年1月1日以降は、第2項第2号により定められている、第1項により割り当てられた財源資金の目的は拘束されないが、資金量の投資的目的は拘束される。
(4) 詳細は、連邦参議院の同意を要する、連邦法で定める。
Article 143c [Compensation for the cessation of joint tasks]
(1) From 1 January 2007 until 31 December 2019, the Länder shall be entitled to receive annual payments from the federal budget as compensation for losing the Federation’s financial contributions resulting from the abolition of the joint tasks of extension and construction of institutions of higher education, including university hospitals and educational planning, as well as for losing financial assistance for the improvement of municipal traffic infrastructure and for the promotion of social housing. Until 31 December 2013, these amounts are to be determined by averaging the financial share of the Federation for the years 2000 to 2008.
(2) Until 31 December 2013, the payments pursuant to paragraph (1) shall be distributed among the Länder in the form of:
- fixed annual payments the amounts of which shall be determined according to the average share of each Land during the period 2000 to 2003;
- payments earmarked for the functional area of the former joint financing.
(3) Until the end of 2013, the Federation and the Länder shall review the extent to which the financing allotted to individual Länder pursuant to paragraph (1) is still appropriate and necessary for the discharge of their tasks. Beginning on 1 January 2014, the earmarking pursuant to item 2 of paragraph (2) of the financial means allotted under paragraph (1) shall cease; the earmarking for the volume of the means for investment purposes shall remain unchanged. Agreements resulting from Solidarity Pact II shall remain unaffected.
(4) Details shall be regulated by a federal law which shall require the consent of the Bundesrat.
