Artikel 115a [Begriff und Feststellung]

(1) Die Feststellung, daß das Bundesgebiet mit Waffengewalt angegriffen wird oder ein solcher Angriff unmittelbar droht (Verteidigungsfall), trifft der Bundestag mit Zustimmung des Bundesrates. Die Feststellung erfolgt auf Antrag der Bundesregierung und bedarf einer Mehrheit von zwei Dritteln der abgegebenen Stimmen, mindestens der Mehrheit der Mitglieder des Bundestages.

(2) Erfordert die Lage unabweisbar ein sofortiges Handeln und stehen einem rechtzeitigen Zusammentritt des Bundestages unüberwindliche Hindernisse entgegen oder ist er nicht beschlußfähig, so trifft der Gemeinsame Ausschuß diese Feststellung mit einer Mehrheit von zwei Dritteln der abgegebenen Stimmen, mindestens der Mehrheit seiner Mitglieder.

(3) Die Feststellung wird vom Bundespräsidenten gemäß Artikel 82 im Bundesgesetzblatte verkündet. Ist dies nicht rechtzeitig möglich, so erfolgt die Verkündung in anderer Weise; sie ist im Bundesgesetzblatte nachzuholen, sobald die Umstände es zulassen.

(4) Wird das Bundesgebiet mit Waffengewalt angegriffen und sind die zuständigen Bundesorgane außerstande, sofort die Feststellung nach Absatz 1 Satz 1 zu treffen, so gilt diese Feststellung als getroffen und als zu dem Zeitpunkt verkündet, in dem der Angriff begonnen hat. Der Bundespräsident gibt diesen Zeitpunkt bekannt, sobald die Umstände es zulassen.

(5) Ist die Feststellung des Verteidigungsfalles verkündet und wird das Bundesgebiet mit Waffengewalt angegriffen, so kann der Bundespräsident völkerrechtliche Erklärungen über das Bestehen des Verteidigungsfalles mit Zustimmung des Bundestages abgeben. Unter den Voraussetzungen des Absatzes 2 tritt an die Stelle des Bundestages der Gemeinsame Ausschuß.

(1) 連邦領域が武力で攻撃された、またはこのような攻撃が直接に切迫していること(防衛事態)の確認は、連邦議会が連邦参議院の同意を得て行う。確認は、連邦政府の申立てに基づいて行われ、連邦議会議員の過半数かつ投票の3分の2の多数を必要とする。

(2) 即時の行動が不可避とされる状況で、かつ、連邦議会の適時の集会に克服しがたい障害があり、または議決不能のときは、合同委員会か委員の過半数かつ投票の3分の2の多数をもって、この確認を行う。

(3) 確認は連邦大統領により、第82条に従って連邦法官報で公布される。これが適時に可能でないときは、他の方法によって公布されるが、可能な状況になったときは、直ちに連邦法官報で追完しなければならない。

(4) 連邦領域が武力で攻撃され、かつ、権限を有する連邦機関が1項1段による確認を即時に行うことができる状況にないときは、この確認は行われたものとみなされ、かつ、攻撃が開始された時点で公布されたものとみなされる。

(5) 防衛事態の確認が公布され、かつ連邦領域が武力で攻撃されたときは、連邦大統領は、連邦議会の同意を得て、防衛事態の存在についての国際法上の宣言を発することができる。2項の条件のもとにおいては、合同委員会が連邦議会に代わるものとする。


Article 115a [Definition and declaration of a state of defence]

(1) Should federal territory be under armed attack or should such an attack be imminent the Bundestag shall declare a state of defence with the consent of the Bundesrat. Such declaration shall be made at the request of the Federal Government and shall require a two-thirds majority of the votes cast and at least the majority of the Members of the Bundestag.

(2) Where the situation calls for immediate action and insurmountable obstacles make it impossible for the Bundestag to be convened in time or it is not quorate, the Joint Committee shall make the declaration with a two-thirds majority of the votes cast and at least the majority of its members.

(3) The declaration shall be promulgated by the Federal President in the Federal Law Gazette pursuant to Article 82. If this cannot be done in time the promulgation shall be effected in another manner; it shall be published in the Federal Law Gazette as soon as circumstances permit.

(4) Where federal territory is under armed attack and the appropriate federal bodies are not immediately in a position to make the declaration provided for in the first sentence of paragraph (1) of this Article such declaration shall be deemed to have been made and promulgated at the time the attack began. The Federal President shall announce that time as soon as circum-stances permit.

(5) Where the declaration of a state of defence has been promulgated and federal territory is under armed attack the Federal President may with the consent of the Bundestag issue declarations under international law pertaining to the existence of a state of defence. Where the conditions mentioned in paragraph (2) of this Article apply the Joint Committee shall act in place of the Bundestag.
